Just so you all know, Sachindra Nepal, the cab driver who was arrested for raping an 18-year-old girl in Ocean City, Maryland, was found guilty on ALL 5 accounts of rape and sexual assault yesterday in court. He is now in a State prison and will be deported back to Nepal as soon as possible as part of his sentence. And to all of you who thought the "ocean city sluts" were to blame for this matter, well, let's thank God that the jury did NOT agree with you.

Tat_Tatto_chiya! I agree with most of the things you wrote but not what follows next and I am assuming you are open to criticisms to improve yourself. Plus, I make a lot of mistakes too. You wrote “ …. The message you intended to express is agreeable but you could have edited it so that we do not look like a 2nd or 3rd class world citizens currently happen to be residing in the US. This is a nation of immigrants. If you really want to get an answer to whose country these continental Americas are? Then the answer is: Native Americans’. They arrived here thousands of years ago by either on boats or by walking across the frozen Bering Strait. You should do more research on Native American history or talk to original inhabitants who still reside in the reservations (and if you are aware of it already then I am just reminding you about it). Mark my words, one thing that is certain is even one needs humongous amount of money to tell the story of hardships or how a particular race was treated unfairly in the past. The free-admission Holocaust Museum in Washington DC is just one example of among many such instances. The Native Americans were often portrayed as the bad guys even in Hollywood movies until people like Brando boycotted the Oscars and sent protest letters. All these dark segments of history (I pray) should not be used as alibi to wage war against the perpetrators but that they should be used by the guilty as a lesson not to repeat the mistakes and the distressed ones to develop defense mechanisms. And it’s not my intention either to generate hate toward any race, religion, background etc. The compromise, in the dispute about whose country this really is, then I would say this country belongs to people who can make this country better in one way or another. As I always say if the zoo had only one kind of animals then what a boring place it will be to visit. The diversity among the variety of people in this world is what makes it an exciting place to be in. ;P

Mr. Obsolete, I know the history of USA and natives here... don't have to remind me... Oh come on... I am fed up of this history lesson. Let me ask you something? does your passport say "Citizen of United States of America"? if yes, then yeah its ur country if It says "Rahdani Nepal" then it is not ur country.... and we are foreigners here... Its just that simple... No need to talk about how this country was created what happened here... and there..... if you really wanna talk about history why go 500 yrs back... go beyond that where u will find we all originated in Africa... from there we migrated... we all live in earth and its our home... no need to be philosophical here.... talking about that.... my heart still aches when I hear there was a bomb blast in somewhere in nepal so I am a nepali, I do not think I will feel the same way about american, Nepal and Nepali will always come first for me. why are u trying to hide you are trying to immigrate here this is not ur country and I don't think we have right to bring that "This country was built by immigrants" crap... I don;'t think there were any Nepali people here when this country was built... This country was built and developed by Europeans, Africans (as slaves) and mexicans as workers... I could go on and on.... but you seem like an intelligent person with knowledge about history... I am sure u get the picture....

Mr. Tat_Tatto_Chiya! On your previous postings, you used the words ‘we’ or ‘us’. Mind you, you don’t have any prerogative to represent me (I don’t know how the other Nepalis feel about them being represented by him). Had you been elected/appointed formally to represent all the Nepalis residing in the US currently then you would have that privilege. It’s like Dick Clark going on national television and proclaiming, " Your government failed you, we failed you, I failed youâ€. Now here is the more serious part, even if you were provided that privilege, I would not simply trust you. You would turn out to be a traitor because of your judgement as you can’t even tell the difference between ‘being reminded†and ‘actually knowing’. Remember that anecdote in which a pet monkey had a golden intention of getting rid of the fly but ended up slashing his master’s nose. I being represented by you will be as abysmal as the story I just outlined. FYI, humans are believed to have been originated in Central Asia and not in Africa. Do not try to mislead people again. Africa,or central Asia for that matter, at the beginning of human evolution was all one big lump of rock, called Pangaea, which was surrounded by one enourmous ocean. Theories also suggest Adam and Eve were black. Scientifically, some research student recently discovered that we are all decendent from black genomes.:P Just chipping in to Human Evolution 101. But again, I might have my facts wrong. Feel free to correct me. But wait, how did we go offtopic in the first place. I suggest we end this discussion of the dood being convicted as it has only provoked general anger and resent. No use crying over spilt milk. In Nepal too, there were gopal banshi, they were defeted by kiratis, who in turn were defeted by lichhavis, and so on most of the Bahun came fron India when Mughals invaded India and now they call Nepal their country. Well now they have assimilated so they are nepali. Also apart from trying to prove me wrong on origin of humans, you still haven't said anything on who made this county.... was I wrong about the europeans, africans and mexicans? wether u like it or not they made this country and I think they have the right to say this country is theirs.... Who are you trying to kid here? we oops (I and so many other sensible nepalis) came here from the same place... When I used we or us, I simply meant those people who came from nepal in search of better life or earn some money.... I wouldn't dare to represent ppl like you. "Baleko aago sabaile tapchha". Loving it man! I learnt so many Nepali proverbs that its actually making me happy.:P My Nepali isnt all that good, and that isnt a fact that I'm particularly proud off. But man! Proverbs in nepali are so much more meaningful:) lol I love that one man..thanks. "Baleko aago sabaile tapchha".

This article appeared in today's issue of Ocean City Today newspaper. Taxi driver guilty of raping inebriated passenger By Nancy Powell Associate Editor (Jan. 19, 2007) The Nepalese taxi driver lowered his head and cried in Circuit Court last week after a jury found him guilty of raping a passenger in Ocean City. “I’ve never been in trouble,†said Sachindra Nepal, 26, knowing that he would be deported to his home country of Nepal, in court in Snow Hill on Jan. 11. A permanent resident of the United States, but not an American citizen, Nepal came to this country in 2003 and obtained an associates degree in microbiology at Austin Community College in Texas. He worked two full-time jobs while earning his degree. He then moved to Massachusetts where he was hoping to get a grant to attend a university there. The grant did not materialize and Nepal came to Ocean City to work in 2005 to earn money for college. He worked at Wawa and then started driving a taxi. The incident leading to the charges against him began on July 16 when he had been a taxi driver for just five days. A man flagged down his taxi near the Bagles and Buns eatery on 71st Street. He wanted to find a ride for an intoxicated 18-year-old woman from Ocean Pines. Minutes earlier, the man working there had found the young woman slumped over at an outside table, her head in a flowerpot. She had ended up there after jumping out of a window at a 73rd Street apartment that police had visited because of underage drinking. When she testified, she said she had drunk three or four shots of tequila, some beer, some rum and cokes, more beer and more tequila. She said she did not have to work the next day, so she was not worried about how much she drank. She said she did not remember the police arriving, but she recalled getting out of the window and hitting the ground. The next thing she recalled was waking up in a strange bed with a man she did not recognize beside her. Nepal testified that the young woman entered the taxi van and told Nepal she wanted to go to Ocean Pines. Nepal drove her there, but she was unable to tell him the name of the street where she lived, although, he said, she was sitting up straight and answering questions. After searching unsuccessfully for a while, Nepal returned to Ocean City. On the ride back to the resort, the young woman became very friendly, he said. “She was holding my hand and putting her hand on my leg and all that stuff,†Nepal testified. He asked her if she would like to go to a hotel with him and she said that she would, he said. They went to the Royalton Hotel, and they went up the stairs hand-in-hand to the third floor to share a room. It was after 2 a.m. The woman later told police that she was embarrassed that her boyfriend and others might find out she spent the night at the hotel. Nepal left the room to park the taxi in a different spot and when he returned to the room, “she gave me her arms,†he testified. She kissed him and he returned the kiss, he said. They engaged in sex and went to sleep. The next morning, they awoke and he asked if she wanted something to drink. He went to get two sodas and she asked him if they had had sex. She told him she did not remember anything. She looked angry, so he told her no, he testified. They dressed, went downstairs and she used his cell phone to call a friend to pick her up. She then gave him $25 for the previous night’s taxi ride to Ocean Pines and back and he left to go to the car wash because she had vomited in the taxi. While at the car wash, he got a phone call from the girl’s mother and then from the police. On Aug. 4, he was served with papers charging him with rape and other offenses. In addition to Nepal and the young woman, the jury heard testimony from a detective, the cook at Bagels and Buns and the desk clerk at the Royalton Hotel. After about 90 minutes of deliberations, the jury found Nepal guilty of second-degree rape, second-degree sex offense, third-degree sex offense, fourth-degree sex offense and second-degree assault. As Deputy State’s Attorney Jennifer Rothschild had said at the beginning of the trial, the facts of the case were not in dispute. Nepal and the woman engaged in sexual relations. What was in dispute was whether she was too inebriated to give consent. Rothschild’s case was that the woman was so inebriated that she was incapacitated and unable to give consent. The law defines mentally incapacitated as being substantially unable to appreciate what’s happening, so the jury had to determine just how inebriated the young woman was. Defense attorney Burton Anderson tried unsuccessfully to convince the jury that the woman was not unconscious and she was not physically unable to resist. She entered the taxi unaided, she held his hand, she kissed him, she entered the hotel, she walked up the stairs and she entered the hotel room. “Nepal had every reason to believe they were engaged in an adult consensual incident,†Anderson said. Being embarrassed about what she has done does not give a woman the right to cry rape, he said. After the jury returned its verdict, Judge Theodore Eschenburg said each of the two young people made mistakes. The woman would never forget what happened to her and the young man, who had had a very promising future, would be deported because the law requires it. Eschenburg sentenced Nepal to one year in jail. The case, he said, did not warrant a five-year sentence. The judge said he believed that Nepal was a nice young man and the woman was a nice young lady. Two lives have been changed and not necessarily for the better, he said. This was the sort of case, Eschenburg said, where there could have been two juries and each would have come up with different verdicts and no fault could be found with either of them. “You had a tough job and you did your job,†Eschenburg told the jurors just before they left the courtroom.

To Mr/Ms/(?) Tat_tatto_Chiya: You can make your essay as lengthy as you want to but if there is not substance in it then it’s just going to result in waste in another reader’s time. I was being really tactful by using the phrases like ‘I hate to criticize every postings†If I happen to be in an another economic-power like (say) Germany instead of the US. I would never claim that I am a 1st class world citizen but this country of US is a nation of immigrants and you don’t have to degrade me or others as 2nd or 3rd class world citizens. But you are free to degrade yourself to underground level if you like. Even the Secretaries of State like Albright, Kissinger were born and raised in countries other than US. Any immigrant could rise to those statures if one is levelheaded enough. Having said that, why the heck does it matter what my passport says. You see now where I am coming from? How do you think the Geneva Accord came about? The answer is: to treat the prisoners humanely. The claim in the US perspective is: the government could have treated the Natives in a better fashion after conquering them. ( Even genocidal allegations have been made too BTW). After all, the US is the main advocate of freedom and democracy, they should set an example. The question of if I came here 500 years ago crap. That’s just a iffy notion. No matter what I would say you will just be speculating. Let’s just get in the facts and not go into where I would have emigrated or what I would have done 500 years ago. After reading the final post regarding conviction, there seems to be lapse in justice system. "The law defines mentally incapacitated as being substantially unable to appreciate what’s happening, so the jury had to determine just how inebriated the young woman was. " "Being embarrassed about what she has done does not give a woman the right to cry rape, he said. " There is no measure of mental incapacitation. I bet if she had woken up with a HUNK/Handsome guy, she would have called her friends to show what a score she had made. Poor Sachindra is just a victim of circumstances (and perhaps his not so handsome demeanure).

the news report is definitely more objective than the originator of the thread. One of the inconsistencies from JennaLinne's story I found was the unproved claim about the woman being found in the morning in the pool of her own vomit and blood. The newspaper does not mention it and I have to say that with today's sensationalist media, you would expect something like that, if the incident or something close to that had happened. And this leads me to a question. How balanced has been the discussion going along in Sajha all this time? I have been following this discussion for a while silently on Sajha. And this news report left out (accidentally?, probably not) by JennaLinne, seems to point that the other side of the story has been completely neglected and ignored. I liked the ending of that report. Kinda balanced yet I could feel an uncomfortable silence. So is it two life changed for the worse or was it just one which changed for the worse (by being deported) and one which misutilized the power given by the law?

Ms Powell (npowell): Thanks for posting the article. Sachindra could have appealled the verdict as provided by law but all that costs time and money. I guess it's time to buy legal insurance as some web-site cites that 70% of households had a legal issue during the past year.

Well, end of the story. Reading above article, looks like jurors were not quite sure what to do and it seems some natural elements have played negetive roll on Sachhindra's side. And Jennlinne, I would have appriciated much if you have not try to deceive others with just one sided stroy. People tends to take side, I know she is your friend or may be your brother's gf, but as a whole I feel sorry for all those involved. I hope everybody has learned something from this case, especially friends out there who are new to state or other places, be careful, don't goof around.

If I were the other judge, I would not be that harsh on sachindra. The result benefits nobody. Things that happened with that girl was an accident and she is not gettin anything by ruining a future of a good student. I feel sorry for the spoiled kids of these white people- they don't have a future, and they don't let others build one. I am so frustated that the law of United States is so unfair. Even the judge told that it was unfair to sachindra, but that's how those whites made the constitution and law. It will keep them always in a superior position, and suck us immigrants. "Nyaya napaye Gorkha janu". You cannot get it here.

When I saw the topic "Nepali Rapist Convicted" instead of "Nepali convicted of a Rape" i got the impression that something was wrong. I asked the creator of this thread repeatedly whether i was missing something but to no avail. While the reality was she was intentionally twisting the case and hiding the truth. Now that I got to read the scene by scene unfolding of the event i have changed my opinion. he should not be deported at all. he should be fined a coupla grand and asked to complete 100 hours of community service. in my opinion that's not rape at all. its the girls attempt to prove her innocence ( cover her sluttiness) in front of her family n bf for which the guy is paying a heavy price. I strongly recommend the guy to appeal his innocence in higher level of court if thats possible. Has anyone watched the movie 'Havoc'. Jennalinne has tried to mislead Sajhaites by obliterating the truth. May god punish her for this sin. On the other hand, Sajha.com should ban this user for one year because she is a bad influence for Sajha community.

Eastsidaz! I completely commend your thoughts and empathy toward this fellow nepalese' distress. The creator of this thread seems to have injected a lot of biased opinions/twisted truth in this thread as fit in the best interest of the accuser's integrity. As the article reads " .... " 90 minutes to decide the fate of a human being???? this is so unbelieveable. Second-degree assault? Not being a law student/ professional I guess I don't understand that part. Any would-be-enlighteners passing by? Isn't it high time that all these Nepali Associations spread all over in the US do something regarding Nepalese having legal issues esp for the ones who seem to have a very strong case of innocence or are they just going to stick to agendas of conducting parties every weekend?

The punishment shouldn't have been for second degree rape, although he should have been punished for his action (may be just deported). Two facts clearly sticks out w/o doubts: 1. The woman didn't make a decision she would have normally made had she been sober. Her feeling of angst next day and remorse justifies this theory. 2. The guy didn't intend to "rape" her, otherwise he would have simply left her after the sex and walked out. OR, he could have done that in his taxi. Now the question is was the decision made with consent of both parties, though one party was not in her best abilities? Well, if the answer is NO, then nobody should be allowed to have sex after drinking. There should be DWC law, Drunk while copulating. If the motel owner can testify that both of these adults walked to the registration table without any aid, then she did have the ability to say NO. Alcohol impairs judgement, but that shouldn't be an excuse. The guy should also have exercised some caution and morality. He just should have been deported for taking advantage, not rape!!
