90th day today. No approval for me and my wife.
My case is at Nebraska. I am thinking they are creating a artificial backlog. Other numbers/cases in front and behind me have their applications approved. It's just 5 people who are stuck.
I tried 3 exxpedite - all denied (even with job offer letter).

@everestial007: so I have asked around other people who have applied and got their applications approved real fast. So far all of those applications were processed in other centers than Nebraska. I think the Nebraska center is backlogged. I did check one before and the one after my number, they were sent out the same time as me, the one after me got their EAD in early July, one before me is just like mine.

Idk what to say. There are 821 cases amidst the 821-D (i.e daca cases). Why would just 5 people's case in my line queue stay pending? Also one case between these 5 cases was accepted on Aug 9. 90% cases are approved (and one case number was approved in 7 days).
I don't see any patterns here, why that island of cases aren't looked at.

The processing times for all the centers are virtually the same (Nepal's TPS doesn't seem to have its independent line). So, its being difficult to find a meaning out of this delay.
Either the case handler is lazy or it's just an artificial backlog.

why is all this happening??????????

@pyackman

Did you see that many people who have their TPS/EAD/AP processed in NSC already have their card.

I visited field office today on infopass. The lady was helpful and put another internal request with some details. I hope it will help.
There was this another guy, and he just went on and on lecturing me but repeating the same whole thing that is posted in USCIS. I don't know what was his problem, he wasn't suppose to help me because he was on another window, but he just jumps infront of that lady who was helping me and keeps talking and talking. I just had to ignore. The lady igrnored him too and was nice.
I think there are these racist people who just don't want to help people. He said that average processing time for EAD was 6 months. If that is the average time then 90% of the people shouldn't have their application done in average of 1-2 months.

Mine TPS/EAD got approved today.
It was quite an experience, being in all this dilemma and wondering about job loss.

Just my theory, but I think this is why it worked:
What I think worked was, that I visited field office (on INFOPASS) last week. The kind old lady was able to raise an internal expedite (not reflected in my USCIS) page. She had quite a knowledge about card production. I think based on her experience she was able to poke/shake the case up and give it a push.
I shall always remain grateful to her.

On the other side, there was this racist sitting in another window and just repeat the same thing that is on USCIS page. Idk why was he even earning a salary for just saying the same thing and being racist. Glad I was not at his window. My case probably would not have been completed today had I been on his window.

So, finally I think what kind of officer comes up your ally really does matter.

@pyacman: I think now is time to discuss on the topic: Does your F1-OPT gets void if you work on TPS EAD ?
I have a friend of mine who worked on TPS EAD while as F1 student (but maintained full credit hours) and has successfully received F1-OPT EAD. If any else has confusion I can help you talk to that person. PM me.

@everestial:
I would not like to discuss on that topic because clearly you already have an "opinion" on the subject. Unfortunately, I do not like to debate and waste my time with people who can back their opinions only with curse words. I can back my statement with written evidence from my highly experienced corporate immigration lawyer. I would advise you to see one too, first appointment is always free. Now, if you think that you are more qualified to comment on an immigration related issue than a lawyer, then I would just like to repeat my first sentence. Good luck.  And I do not understand why you would think I would gain anything from spreading false information. Anyways, it is none of my business about what you do. Pyackman out!

@pyckman:

- Not not an opinion on my side but yours by spreading a false information.
- I didn't use curse word on you in any of this conversation. The curse words were there to pacify my frustration and were directed only at the ... . So, you can keep that aside.

Because it concerns all the individuals who are/were on F1/F2 and worked under TPS EAD. I want to request you to provide the name, link and number of the lawyer who gave you that information. Please don't PM me just post it, because it concerns us all.

I also suggest you and others interested ones to look at these links (which are from lawyers):

1) Confusion of, if TPS voids F1 status when TPS was first granted to Nepal : http://sajha.com/mobile/info.cfm?threadid=113891 . I think we have been over this already.

2) Response on the same topic from other lawyers:
- https://www.avvo.com/legal-answers/hello-------------f1-to-tps-and-tps-to-f1-2256825.html
- https://www.avvo.com/legal-answers/can-a-student-with-f-1-visa-work-with-tps-ead--wil-3565825.html ; In this link one lawyer says that TPS violates F1.

3) Here the attorneys from same group/website provide contradicting information: http://myattorneyusa.com/suspension-of-certain-regulatory-requirements-for-qualifying-f1-students-from-nepal supports TPS with F1, while http://myattorneyusa.com/using-employment-authorization-from-tps-while-holding-nonimmigrant-status the same web forum now contradicts that TPS EAD voids F1.

Finally, there is a divide on, if taking employment under TPS EAD voids another nonimmigrant status. However, majority of the lawyers and attorneys support that EAD under TPS is provided to relieve the economic burden of the F1 students while also providing means to send money back home which indirectly support economy of the afflicted country. So, working on TPS EAD doesn't affect F1/F2/H1B status given the requirements for those status are met.

My point is, if TPS EAD violates other non immigrant status then it should only be illegal immigrants applying for TPS, because the generosity of given TPS wouldn't be utilized otherwise by lawful F1/F2/J1/J2 etc. Saying working under TPS EAD jeopardizes your F1/F2/H1B etc etc. send a double and ambiguous message.

And, finally the words of law are subject to change and are finally defined by the judges (at several level).
It's like this statement, "There is a man eating lion."
So, is there a man who is eating lion; or is there a lion who eats man ?? I believe there is large consensus among attorney/lawyer that working under TPS wouldn't violate any thing given that other status were maintained. But, let see how the climate unfolds as the TPS termination dates near for each countries.

I am waiting to hear how this recent administration will take the benevolent TPS based relief that was provided to use it against the lawful immigrants.

Willing to talk further if need be.

TPS EAD Approved today, exactly after 3 months. I think at least 3 months we should wait.
