I am curious too.
Under what rationalization, or should I say pretense, can Nepalis apply for asylum? This has dumbfounded me for a while. Can anybody please shed some light on this?

Count me in your confusion Riten. I guess our peeps are in a tyrannical rule of poverty, nepotism and lawlessness and hence want to file asylum. Obviously they will not mind visiting the country every year via different routes (India mostly), which makes this case further more strange. But, such is the rule of this country. Feels strange specially since we've been living here for 10 years and still awaiting the residency status because we took the "right" way. But who is to say what is the right way. Also, when I think of who is getting the benefit (i.e. my own peeps) I don't mind this at all. Let those people who have suffered back home get the damn thing. If the immigration process here is stupid enough to accept it, why not our own people make use of it? They are playing by the rules, so let them enjoy while it lasts.I don't blame them at all given what they have to go through back home. May you get the status soon. Go via a good experienced lawyer, even though it might cost more. Don't go via agents.

What bothjers me the most about the asylum situation is curropted leaders,crook govt service people, crook police officers and other middle aged crooks filing asylum here and going to Nepal after few years to loot more and get more looted money out of the country.

Yes, that is all true. I know most, if not all, Nepalis file for asylum because of economic reasons. But what I would like to know is on what grounds does the US government provide asylum to Nepalis.
It's not that Nepal is a violent dictatorship like North Korea. Neither is it a socially oppressive country like some of those sub-Saharan nations where they enforce brutalities such as female circumcision. Nor is it a Maoist nation suffering from their so called "cultural revolution", at least not yet.
So for what factor does the US immigration see as compelling reason for granting asylum?
It is purely academic curiosity and I am not trying to be judgmental here. I perfectly understand that that if there is a legal path, then people have all the rights to pursue their desires.

well Maoists did kill over 13 thousand people in the bloody 10 year battle. The army and other political people , includig maoists are still persecuting people. Maoists are in the list of bad boys for America. So yes, a Nepali with a genuine fear of persecution does qualify for political asylum in the USA. It's not only Nepalis chinese, Indian and other people whose country condition is similar or better than Nepal also may qualify for asylum based on the individual personal fear of persecution. That does not mean all Nepali or chinese qualify for asylum however. The good American govt would rather grant the asylum then to deport the people back to the country where their life is danger. it is the most generous thing in the world and often misused by crooks. you and other Nepali should start reporting fake asylees to the DHS or USCIS so misuse can be stopped.

Nepali Kancha when u file asylum there is very very little chance to approve in the present scenario. In you are story you have show that there is direct threat inyour life if u go back to nepal. If u cant prove then u r case cant be approve. they gonna say that u can stay in other countirs like india . if your case didn;t approve you will have great problem to find the job after u graduate or say if u get married with a u s citizen. u came in the f1 visa and u r case is already fake..plus when u file u r case not all the states are easy for asylum only newyork and california is good ..and when u fil for asylum u have to go for biometrics, interview..its lots of hassle.better finish u r study try to find a job and if not find a us citizen and get married or go back to nepal with the degree and some money..gd luck

Hoina hoina, nirutsaahit paareko hoina.
I genuinely wanted to know, kya. As far as I am concerned, everybody has "the right to life, liberty and pursuit of happiness" as it says so in our constitution.
If your pursuit of happiness is gaining refugee status in the US, more power to you. I just wanted to know the thoughts behind it.

hey asshole ppl, i wonder why u guys even think of filing ASYLUM, unless u really have a problem back home or can't stay at nepal. the whole story of all nepalese living at USA is how to get a greencard hoina ra. but this system have prove in the whole world that nepalese are the un-trust able and cheap people in the world. Stay the way you feel good. The system of filing ASYLUM by nepalese has tighten all the visa in the nepal not hardly few ppl gets visa at nepal. and secondly, who ever graduating in USA tries to invited their parents in usa, their parents are not issued any visa to visit their children's graduation too. Further more, there is some process to file ASYLUM. u will have to hire a laywer, and second u will have to show some proof why u can't stay in nepal and what is ur real problem, if u talk to ur laywer , they can make some reason according to their charge. If u are approved with your reason then u will be accepted , and looking at the current condition , Nepal is the second country to file ASYLUM in USA and the rate of ppl who got accepted after filing ASYLUM is very low . till 4 yrs ago. most of the ppl used to get accepted. but now its rare. coz usa knows that nepalese file ASYLUM just to stay here,
SO I SUGGEST U guys to think 100 times before u file ASYlUM, its not sure that u guys will have better life. i know most of the ppl who got accepted , are still in gas station and restaurant, and out of the social life and some have problem going back to home and haven't visited their family for long time period.. Personally i do not recommended u guys to file asylum, try to do better work somehow...

ya the dude is right they are rejecting 80 year old grandmmas for visa to come over here now a days. the fake asylee usually come here to drop their children to school or for graduation and not return. so that has lowered the chances for genuine parents to get visa to come for their childrens graduation etc. so is it hard to get asylum from cali too these days? good to hear. i couldn't bear seeing these fake liars getting away with the law while i waited 12 years to get turn with legit route.
