Friends, Need some Information regarding H1B visa. Is there a requirement to enroll at school after your H1B is filed? This is a case of transfering F1 to H1. Please throw some suggestion. Thanks

if you are on PT(Ptractical Training), then you don't have to enroll to school. Otherwise, you have to go school till your petition approved by INS. This is because, if your petition denied, you won't be out of statue which is the hell.

What if one receives the pre-approval? There are two scenerios, 1) :> If one files through the premium process, he or she might be able to receives the pre-approval or denial within 15-20 days. 2) :> If one files through the regular process , it might take anywhere from 3-6 months. My concern is, if one get the pre-approval, is it safe not to enroll at school or regardless it has to be enrolled at school, until one gets actual H1. Anyway thanks tmobile.These rules are killing us. Work all summer,->> save little money >>>>pay tuition. never ending cycle. Preety frustating.

Hey, As far as i know, there is no such thing as pre approval. Either you get approved or not. Once you get approved, you will get the paperwork stating that you are on H1 status. In order to travel outside of US and to com back however you need to get the H1 Visa stamp on your passport and you can do that either in Nepal or Canada or Mexico.

There is pre-approval. That is when the INS has deposited the check you have sent them for H1b, and when whoever filed your H1 recieves a reciept number. Even though there are chances that it might get denied after that, the chances are pretty slim.

That's not a pre-approval. That's just a case number that you can refer to, to check your case status. It's simply a receipt notice. That does not mean your case will be approved. You have to receive a notice of approval. Premium takes about 10 days. Regular H1B processing about 2 months provided the cap is not reached. To answer the original question, yes you have to stay enrolled in a school until you receive a notice of approval for your H1B visa. That is if you are on F-1 status now and don't have OPT or EAD.
