thapap:could you please give your valuable inputs in following scenario? I am in h1b and I have paystubs for last one year -latest paystub is of July 1.If I proceed to transfer to another company,what should I do if USCIS sends me a RFE(Request for Evidence) asking for a recent paystub of July 15 and coming Aug 1which I won't have.Any recommendation is highly appreciated. Thanks in advance

First, Once USCIS receives the H-1B Transfer petition, you are good to start with the new company. Second, you do not have to wait for the approval or the receipt notice. Some prefer joining upon receipt of the receipt notice. Third, RFE is only issued for the issues relating to the date prior to the filing. Therefore, the anticipated RFE, will not have such inquiry. In case they ask for pay stubs, which is highly unlikely, after the date of filing, you can submit pay stubs from the new company. Good Luck.

If RFE is issued for the issues relating to the date prior to the filing,they may ask of paystubs of July 15 and Aug 1 if my H1b transfer process starts on August 2.What should I do in that situation coz i will only join new company once I get receipt of H1b transfer process? Thanks

hmm.... even though its sat morning u got my attention he he he (O: 1. my suggestion would be do not change job until you got H1-B receipt. if you can spare use that $1000 for premium processing and spare yourself with all these headaches .. 2. i would second attorney @ law giri jyu, regarding RFE. since you had current Pay stubs @ the time of filing H1 transfer you would be spared with the RFE. [ reason being your July 15 paystub will not be ready till the 15th and you would not receive it until lets say 19th ] so July 1st pay stub will be the most current. it would work i am including you a link here here this should answer some of your doubts ==================================================== LOL... but i would still say what do i know (O:
