Why don't you apply for TPS if you are in second graduate studies. They won't give you opt if you already had one.

Thanks Mangale. I am considering applying for a TPS. I am not sure if I can continue taking classes while on TPS though.

Does not matter, since you are in F-1, you I-94 is valid "DURATION OF STATUS".... also you need to get recent and updated i-20 all the time and make sure it has never expired. that should be fine. Visa doesn't matter.

The Embassy might seek explanation for being in student status for 10 years while you go for the interview. You will be fine if you are able to give them a valid justification. As you are on legal status, I would not recommend you to apply for TPS before traveling to Nepal/getting a new visa. Generally TPS is good only for those who have run out of status. If you do so, this will definitely come up during your interview. They will ask you the reason for applying TPS while you're on F1 status. Remember as per law, they will be seeing if you as an intending immigrant unless you prove it otherwise. If they concluded that you did TPS only for EAD, you might run in to problem. and don't forget to apply DV 2017

Sarojk, Generally by law, you need F1 visa if your purpose of travel to US is to study when you hit the border. In this situation, I don't know how your Advance Parole doc will help you but they will definitely put you in to secondary inspection. Please remember that USCIS says that Advance Parole does not guarantee the entry of the document holder. Apply for DV.

Sarojk, I was wondering if you went back home and got your F1-visa renewed. I would appreciate your response. Thanks!

Jogee, You can take classes even if you have TPS. Its upto you but you have to maintain your status till you approved for TPS. I also went thru your situation and applied TPS last year but i did not take classes because i did not want spend money on classes. Now I am going through consultancy like everybody is doing for better career.
